  1. General provisions

These provisions constitute a privacy policy (hereinafter referred to as the “Privacy Policy”), which defines the legal basis for the processing of personal data and information on the collection and use of personal data by AWG-EUROPE LTD. (hereinafter referred to as “AWG-EUROPE LTD.” or “Administrator”). The Privacy Policy is an integral part of AWG-Europe Kft’s policy regarding to https://wizzwell.com web shop and https://awgeurope.com  and https://atmosphericwatergenerator.eu websites. Before the Customer starts using the services of the web shop or subscribe for newsletters, he must familiarize himself with the Privacy Policy.

AWG-EUROPE LTD. uses personal data for the purposes indicated in the Privacy Policy and for other purposes, however, these are clearly defined each time in the Information Clauses presented to the Clients.

The controller pays special attention to the protection of the interests of the persons whose data it processes. The controller collects and processes personal data:

  • in accordance with generally applicable legislation;
  • for the specific purposes and for other purposes indicated in the Privacy Policy, but these are clearly stated in the Information Clauses each time;
  • in accordance with the objectives and tasks set;
  • in accordance with applicable retention periods – no longer than necessary to fulfill the relevant processes, rights and obligations, and in accordance with the deadlines specified by law;
  • protect against unauthorized and unlawful data processing and against loss, damage, destruction or alteration of data in accordance with applicable data processing security standards, in particular by the necessary technical, organizational and procedural measures.

Personal data – information relating to a natural person identified or identifiable on the basis of one or more factors characteristic of his physical, physiological, genetic, mental, economic, cultural or social identity.

Information clause – any information provided pursuant to Articles 13 or 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, when data are collected by the Data Controller.

Customer – a natural person, including a consumer (i.e. entering into a legal transaction not directly related to his business or profession), who has the capacity to carry out legal transactions, without the ability to carry out legal transactions, requires the consent of his legal representative or legal representative, and II.) a legal person and an organizational unit not qualifying as a legal entity to which special provisions grant legal capacity, who uses or intends to use the service, including the Internet Shop and/or the Internet Shop in the cases described in the regulations.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC.

Data processor – a natural or legal person, authority or other organization that processes personal data on behalf of the Data Controller.

Profiling – any form of automated processing of personal data. Through profiling, it is possible to assign a personalized, unique, specific offer to a specific client.

Processing – the set of operations or operations which is performed on personal data, e.g. collection, recording, organization, storage, adaptation or modification, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Pseudo-anonymization – processing personal data in such a way that it cannot be attributed to a specific, specific data subject.

Internet Shop – the administrator’s www.wizzwell.com website accessible at www.awgeurope.com and www.atmosphericwatergenerator.eu address, which allows electronic trade of products.

Consent – – a concrete, informed and unambiguous expression of will by which the data subject gives his or her consent to the processing of personal data concerning him or her, either by means of a statement or by a clear affirmative action.

  1. Data processing related to the use of the web shop

In connection with the User’s use of the web shop, the Administrator collects data to the extent necessary for the provision of certain services offered, as well as information about the User’s activities in the web shop. The detailed principles and purposes of processing personal data collected through the use of the user are described below.

  1. Legal bases

All personal data shall be processed in accordance with applicable Hungarian and Union law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The controller collects and processes personal data when:

  • the data subject has given his or her consent to processing (for a specific purpose) – in accordance with Article 6 (1) (a) GDPR;
  • the data subject has concluded a contract with AWG-Europe Ltd. (in particular a sales contract or commercial contract) or intends to conclude or terminate such a contract, or intends to carry out its provisions or other activities related to the contract – pursuant to Article 6 (1) (b) GDPR;
  • this is necessary for compliance with a legal obligation to which the Controller is subject – in accordance with Art. 6 para. 1 lit. c GDPR;
  • it is necessary for the enforcement of the legitimate interests of AWG-Europe Ltd. or third parties, unless these interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular if the data subject is a child – pursuant to Article 6 (1) (f) GDPR.

The Data Controller processes personal data only if the prerequisites for the aforementioned legal bases are met. Specific examples of the processing of personal data, as well as the specific legal bases for processing personal data, are set out below in the Privacy Policy – in relation to the specific purpose for which the controller processes personal data. For example, if the Customer decides to make a purchase in the Internet Shop and chooses to collect the purchased product in person instead of delivery by courier, his personal data will be processed for the purpose of fulfilling the concluded sales contract, but will not be made available to the carrier performing the delivery on behalf of the Administrator.

Please note that by displaying AWG-Europe Ltd.’s website at any of our websites, information is exchanged between your mobile device, computer or other device and AWG-Europe Ltd’s web hosting in the available internet browsers. The information received in connection with the display of the website is used for the smooth operation of IT processes on the AWG-Europe Ltd. website or for other processes taking place in your browser. When displaying the any of our website, your browser may transmit the following information: Your IP address, time of entry and exit, name and URL of the displayed file, page or application from which you accessed it. This data is transmitted to ensure the security and stability of the Website and its comfortable and uninterrupted use. The above data is processed in accordance with Art. 6 para. 1 lit. f GDPR – for the above purposes.

The aforementioned data will only be stored for the duration of your visit to AWG-Europe Ltd’s Online Shop and will be automatically deleted when you close the aforementioned website, unless you have purchased a specific product(s) available in the Online Shop. In case of purchase of product(s), we may store your aforementioned data for one year, for the duration of the performance of the contract, for the period arising from tax and accounting regulations, and for the time necessary to enforce any claims of AWG-Europe Ltd. (in accordance with binding legal provisions).

If you use the search engine of AWG-Europe Ltd. or WizzWell store (available on the website), your browser will be given the opportunity to process this data in order to find the nearest store in your vicinity based on your consent to provide geolocation data. Please note that these data are not stored by AWG-Europe Ltd. in any way and are automatically deleted after closing the website.

We process your personal data each time for a specific purpose and according to a specific legal basis. The selected processes related to the processing of Personal Data are described below:

  1. Data retention

Depending on the purpose and legal basis, your data will be stored for the following period:

  • for the conclusion and performance of a contract – we store your data for the duration of the contract (e.g. sales contract, commercial contract and other contracts);
  • for direct marketing purposes – we will retain your data until you withdraw your consent for marketing purposes;
  • for marketing purposes – your data will be retained until you withdraw your consent for marketing purposes;
  • To investigate or defend potential claims – we will store your data until the expiry of the deadline related to the claim (as required by law);
  • for the purpose of handling a complaint or other report – we store your data until the complaint is resolved and thereafter until the limitation period for claims (arising from the case);
  • for tax and accounting purposes for the period specified by law;
  • for other purposes – we may store your data for other purposes with a strictly defined retention period (for the specific purpose of processing), but in the particular case we will always inform you about your rights and obligations by displaying information clauses.

We process your data only for as long as is necessary for the respective purpose or the aforementioned obligation arises from applicable law. The administrator regularly checks all databases, media and deletes unnecessary data or they are automatically deleted.

  1. Monitoring (shops/locations)

AWG-EUROPE LTD. sells products and conducts customer traffic exclusively through an online channel. If, for any reason, the customer acts in person at the company’s premises, we inform him that video surveillance is installed on the premises, so that video and audio recordings may be made of you during his stay, which will be stored at the headquarters of the administrator. The recorded data is processed to ensure the safety of persons and the protection of property, as well as to preserve the confidentiality of confidential and commercial information contained in the aforementioned areas. Your personal data will be processed for a maximum of 30 days or until the conclusion of proceedings in cases where they constitute evidence in judicial, enforcement, mediation and other matters (in accordance with statutory provisions). The recipients of the data are our employees, employees and other authorized organizations (public authorities and organizations cooperating with the Company on the basis of a separate agreement).   1. Contact form

Personal data of persons using the contact form (including: name, surname, phone number, e-mail address) are processed by the Administrator in order to identify, send and manage the inquiry sent by the user through the specified form – the legal basis for processing is the legally justified interest of the Administrator.

The provision of data marked as mandatory is necessary for the Administrator to receive and manage the user’s request. Failure to provide such information will make it impossible to handle your request. The provision of other types of information is voluntary, but may be provided by the user to facilitate contact with the administrator or handling the request.

  1. Marketing

The controller processes your personal data for marketing purposes. This may include sending you e-mails about offers or content, which in some cases may contain commercial information (newsletter service). The newsletter service is provided by the Data Controller to persons who have consented to this and provided their e-mail address for this purpose.

Personal data of persons (including e-mail addresses) are processed by the Data Controller:

  • for the provision of the newsletter service – the legal basis for data processing is the consent given by the user to receive newsletters by accepting the relevant checkbox;
  • for analytical and statistical purposes – in this case, the legal basis for data processing, which consists of a statistical analysis of the effectiveness of our marketing activities, is the legitimate interest of the Data Controller in improving our marketing communications;
  • for the possible establishment and enforcement of claims or for the defence of claims – the legal basis for data processing is your legitimate interest in protecting your rights.

The provision of the above data to the Data Controller is necessary for the provision of marketing and newsletter services. Failure to provide this information prevents us from sending marketing messages to users or from providing newsletter services.

  1. Business partners

These provisions also apply to persons who are bound by a cooperation agreement with AWG-Europe Ltd., who contact the company to enter into a partnership, or who negotiate an agreement between the parties. The scope of the data processed depends on the specific, individual case and the nature of the respective agreement. The data collected for these types of agreements includes, for example: name, surname, address, e-mail address, mailing address, date and place of birth, nationality, ID card number and series, sample signature, tax identification number, business registration number, payment details. The legal basis for data processing is Art. 6 para. 1 lit. b and f) GDPR (depending on the facts). At AWG-EUROPE Ltd., access to such contracts is provided by the departments responsible for their procedure and negotiation, as well as by the legal and accounting departments and other organizations with a legitimate interest, including other organizations cooperating with AWG-Europe Ltd. (service providers and subcontractors), but they perform their activities only to the extent indicated in the assignment and data contracts.

  1. Social Media

In order to provide you with up-to-date information about new products and promotions, AWG-Europe Ltd. transmits all information via social media (Facebook, Instagram, YouTube). The personal data of social media users are processed by the Data Controller in connection with the profile of the Data Controller on a given website, in particular for the purpose of promoting events, services, marketing campaigns and products sold by the Data Controller.

  1. Data recipients

For the proper functioning of the web shop, including the performance of concluded sales contracts, it is necessary that the Data Controller uses the services of external organizations (e.g. software provider, courier or payment agent). The controller only uses the services of processors who provide adequate guarantees to implement appropriate technical and organizational measures to ensure that the processing complies with the requirements of the GDPR Regulation and protects the rights of data subjects.

The Data Controller does not transfer the data in all cases and not to all recipients or categories of recipients indicated in the Privacy Policy – the Data Controller transfers the data only if this is necessary to achieve the specific purpose of processing personal data and only to the extent necessary to achieve the purpose. For example, if the Customer uses personal collection, his data will not be passed on to the carrier cooperating with the Administrator.

Personal data may be transferred, inter alia, to the following recipients or categories of recipients:

  • carriers / forwarders / courier intermediaries – in the case of the Customer using the courier delivery method in the webs hop, the Administrator shall provide the collected personal data of the Customer to the selected carrier, forwarder or intermediary, who will make the delivery on behalf of the Administrator, to the extent necessary for the delivery of the product to the Customer;
  • organizations processing electronic or credit card payments – if the Customer uses an electronic or credit card payment method in the web shop, the Controller shall make the collected personal data of the Customer available to the selected organization processing the above-mentioned payments in the web shop on behalf of the Administrator, to the extent necessary to handle the payment made by the Customer;
  • organizations conducting audits (financial, legal, other) on the premises of the Administrator;
  • entities providing legal advice in the name and on behalf of the Fund Manager, participating in judicial, mediation, enforcement and other proceedings, as well as notarial offices or tax advisors;
  • entities operating information systems (IT systems, payment systems and others);
  • in particular, to authorities authorized by law: Public authorities (e.g. the tax office in the case of tax inspections), the police, courts and others, if so provided by law;
  • other enterprises of AWG-Europe Ltd.
  1. General rules on data processing
  • The rights and obligations of the data processor in relation to the processing of personal data shall be determined by the controller within the framework of the law and special laws applicable to data processing.
  • The Administrator declares that in the course of its activities the data processor has no competence to make a substantive decision on data management, may only process the personal data obtained in accordance with the provisions of the data controller, may not process data for its own purposes, and is obliged to store and retain personal data in accordance with the provisions of the data controller.
  • The Administrator is responsible for the lawfulness of the instructions given to the processor regarding data processing operations.
  • It is the obligation of the Administrator to provide information to the data subjects about the identity of the data processor and the place of data processing.
  • The Administrator does not authorize the data processor to use another data processor.
  • The contract for data processing must be in writing. The processing should not be entrusted to an organization that has an interest in business activities using the personal data to be processed.
  1. Transfer outside the European Economic Area

Please note that your data processed by AWG-Europe Ltd. will not be transferred outside the European Economic Area (EEA).

  1. Rights of data subjects

In all cases, Customers have the following rights:

  • Right to information – The data subject shall have the right to be informed of the information related to data processing prior to commencing an activity aimed at processing his or her data.
  • Right of access – You have the right to access the data we process (in accordance with Art. 15 GDPR);
  • Right to request rectification – You have the right to update the data you have provided to AWG-Europe Ltd. (pursuant to Art. 16 GDPR);
  • Right to erasure (right to be forgotten) – You have the right to have your data erased if they have been processed unlawfully or if the data are no longer necessary for the purposes for which they were collected (pursuant to Art. 17 GDPR);
  • Right to restriction of processing – You have the right to restriction of processing if the controller no longer needs the data for the purposes for which they were processed, the data are incorrect or the processing is unlawful (pursuant to Art. 18 GDPR);
  • Right to data portability – You have the right to have your data transferred to another controller and to receive your data in a structured, commonly used and machine-readable format (in accordance with Art. 20 GDPR);
  • Right to withdraw consent – You have the right to withdraw your freely given consent at any time, which revocation does not affect the processing lawfully carried out by the Data Controller before its withdrawal (pursuant to Article 7 (3) GDPR);
  • Right to object – You have the right to object if processing is carried out on the basis of the legitimate interests pursued by the Data Controller or by a third party, including in particular processing for marketing purposes, including profiling, insofar as there are no other valid legitimate grounds for the processing which override the interests of the Client (pursuant to Art. 21 GDPR);
  • Right not to be subject to automated decision-making – The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or similarly significantly affects him or her.
  • Right to lodge a complaint with a supervisory authority – a person whose data is processed by the Data Controller has the right to lodge a complaint with the supervisory authority in the manner and in accordance with the procedure specified in the GDPR Regulation and Hungarian law.   • Right to an effective judicial remedy against a supervisory authority – Without prejudice to any other administrative or non-judicial remedy, every natural or legal person shall have the right to an effective judicial remedy against a legally binding decision of a supervisory authority concerning them.

In order to exercise the aforementioned rights, you must send an appropriate message to the Administrator in writing or by e-mail to the address provided in the section below. Section 5 of the Privacy Policy.

  1. Data Volunteering

The provision of data is always voluntary. To the extent specified in the rules of the web shop, the provision of data is necessary for the conclusion of the contract (e.g. sales contract, service contract). If you place an order through the www.wizzwell.com website, you can provide your data for the following purposes without consenting to its processing: sending newsletters, expressing opinions about purchases, sending emails about current promotions (marketing), sending SMS messages about the status of your order. If you have given your consent to the processing of your data for the above purposes, you can withdraw this consent at any time in accordance with the provisions of the pt. according to point 5 of the Privacy Policy, according to which the withdrawal of consent does not affect the compatibility of data processing before its withdrawal.

  1. Profiling

In order to provide the most advantageous, personalized, offer to its Customers and data users, as well as to the Data Controller, and with the explicit consent of the data subject, the Data Controller may use “profiling”.

Profiling consists of automatically analyzing or predicting a person’s behavior on the website of the web shop, e.g. adding a particular product to the cart, browsing the page of the given product in the web shop or analyzing the history of purchases made in the web shop so far. The condition for such profiling is that the Data Controller has the person’s data in order to send him, for example, a discount code. The effect of using profiling in the web shop may be, for example, to provide a discount to the person, to remind him of incomplete purchases, to send a product offer that may correspond to the interests or preferences of that person, or to offer more favorable conditions compared to the standard offer of the web shop. Despite profiling, the Customer is free to decide whether he wants to take advantage of the discount received in this way or the more favorable conditions and make a purchase in the web shop.

  1. Cookies

Cookies are small text files that are installed on the Customer’s device when browsing the Online Store. Cookies collect information that facilitates the use of the website, for example by storing the user’s visit to the web shop and their actions. A detailed description of the cookies used on this website is available in the cookie management tool (the link can be found in the bottom footer of the website under “Manage cookies”). Below is a general description of the categories of devices we use in the Online Shop.

  • Necessary cookies – The Data Controller uses so-called necessary cookies primarily to provide electronically provided services to the user and to improve the quality of these services. The use of essential cookies is necessary for the proper functioning of the website.   • Analytical cookies – Analytical cookies allow us to see the number of visits and sources of traffic to our website. They help determine which pages are more popular and which are less popular, and understand how users navigate the page. AWG-EUROPE LTD. also uses so-called third-party cookies to operate its websites, which are used, among other things, to collect statistical data and to monitor how users use the websites, as well as to personalize marketing messages (e.g. through personalized advertising based on user activity or retargeting, i.e. displaying specific advertisements to the Customer on other websites on the Internet).

We use Google Analytics for these purposes. It is a publicly available tool for analyzing website usage and reporting user activity. Google Analytics generates information about the URL, the type of browser used by the user, the user’s IP address and the operating system used. The tool determines the number and length of visits to servers and collects data about which parts of the website visited by users most often (analyzing their functionality).
